Users must read and accept these Terms of Use before buying, submitting and using the products of this site.
The terms and conditions outlined below apply to all the users who buy, sell and access BuySellWordpress’s website (site) and its products.
By becoming a member at BuySellWordpress you acknowledge that you understand these Terms of Use Policy and agree to be bound by their rules.
These Terms of Use are applicable as long as you are a member or author of the site.
BuySellWordpress (site) is a marketplace where its members act independently. The members can buy, sell and view items on the site. We are not involved into any disputes which may occur between Buyers and Sellers. We have no control over the quality, legality, truth or accuracy of the items, descriptions and contents listed on the site.
If you decide to send a query regarding any further update, upgrade, modification, amendment or improvement of the product you should send it directly to the author through the form on the author’s page. BuySellWordpress is not involved in any further interactions between Buyers and Sellers.
3. Registration, Membership and Authorship
Everyone can access the site and use the services provided on the site. However, it is required to become a member to access some areas, contents and services on the site.
During the registration we do ask you about your personal data (such as full name, email address for Buyers; billing name, billing address, billing email and PayPal email to withdraw the payments for Sellers) but do not disclose, sell nor share these data with any third parties or public.
Registration: The registration is free of charge. By becoming a member you agree to be responsible for any access or use of the site and the admin areas of the site through your username and password. You also agree that your username will be public, thus, seen by other visitors and users, and cannot be changed in the future.
Buyer: It is required to register at BuySellWordpress to purchase items from the site. You need a valid PayPal account or credit card with you to make a payment.
Seller: It is required to register at BuySellWordpress to purchase and (or) sell items from the site. Authorship is open to those approved by administrators of the site. In order to sell items you must provide and maintain valid payment information (such as valid PayPal email address).
BuySellWordpress team reserves the right to block or cancel unconfirmed or inactive accounts; refuse or reject accounts or submissions of anyone, for any reason, at any time. Site’s services are not available for temporarily blocked or rejected accounts or submissions.
Should you decide to terminate the membership, you need contact our tech support department.
Account information: We strictly recommend you to keep your account username and password up-to-date, accurate and secure.
Only registered members can buy from the site. It is required to have a valid PayPal account or credit card in order to make the payment.
Once paid, you agree not to make any cancellation on the order.
The download links for purchased products will be activated within 20 minutes after the payment has been approved by a merchant company. Once your order is approved and processed you will receive the notification by email. The purchased products can be downloaded from the “Orders” section in one’s personal profile on the site. The download links for the products are available during the life time.
BuySellWordpress provides the services as an independent contractor and acts on Buyer’s or Seller’s behalf to assign PayPal to charge a PayPal account for the instructed amount, or to do similar for any of the other payment systems used on the site.
License to use purchased items from the site: When purchasing the item you get a limited license to use the product. The license is limited to your use only, and you agree not to engage, directly or indirectly, without the written consent of us or the supplying member, in any licensing, sublicensing, promotion, advertising or distribution of the product.
5. Listing and selling items from the site
By submitting and listing a product the author warrants that the following item complies with BuySellWordpress policy and doesn’t infringe the Intellectual Property Right of any person. The author also warrants one’s right to offer and sell the product. The author is fully responsible for the quality, legality, truth and accuracy of the items, descriptions and contents of submitted items on the site.
Submissions to our site can use only legal stuff. The author may also use third-party content which is provided under Creative Common license or downloaded from public stock sites with special template license. If you are using any kind of third-party content you must include it within the template description. Your account might be blocked if you use the copyrighted stuff.
Submitted item must include a valid, short and self-explanatory name, reasonable price (which will be reviewed by a manager prior to acceptance), accurate description along with a corresponding listing of included files, required software programs, available documentation and valid demonstration link. The item must be listed under appropriate category and with appropriate tags. The product thumbnail and preview images must be of a proper size, dimension and quality. Make sure that the main product zip file contains all the necessary files and documentation (if any applicable).
Members who submit the products to the site (aka Sellers) earn a commission from every item sold from the site. According to the license’s types, there are two types of commission a Seller can receive. By selling the item under non-exclusive license a seller earns 20% commission. By selling the item under the exclusive license a seller earns from 50% and up to 70% commission (the commission value is calculated from a total sales value, according to our Payment Rates table).
The payments on BuySellWordpress are processed at the beginning of each calendar month, and in the case when your account balance reaches the threshold of $100.
So at the beginning of each month, if your account balance from the previous month reaches $100, you will be paid out on the 1st - 5th of the current month. If your account balance from the previous month hasn't reached $100, we will roll the amount from balance over the next month, until the payment threshold is reached.
The Buyers and Authors (Sellers) are solely responsible for ones activities and content which are posted, submitted or displayed on the site.
What kind of content cannot be listed on the site: It’s forbidden to post, submit or send adult, illegal, rude, improper, abusive, copyright protected, promotional, violent, spam or nonsense content into the site. Neglecting the following rules will cause your account (or submission) blocked permanently or removed completely.
Prohibited, questionable or suspicious items or content: If you feel that any of the contents (yours or someone else’s) has been copied or used illegally, please report a violation case to our support dept with the following information: describe the place the content in question is located, point to the place where the copyrighted content is located, prove that you are the copyright content owner (if you are referring to your content being used illegally).
BuySellWordpress reserves the right to remove or block any content (including products) without notice and being responsible for any loss due to the removal.
License: The items on BuySellWordpress can be sold under any of two license types – exclusive and non-exclusive. The non-exclusive license allows you to sell the item on other websites, portals or marketplaces at the same time. The exclusive license grants you the right to sell the item only on BuySellWordpress site and earn from 50% and up to 70% on every item sold.
8. Our right to cancel an account, submission or transaction
BuySellWordpress, in its sole discretion, reserves the right to block (cancel) new or existing account, submitted post, submitted or active product, or transaction for any reason, at any time.
If any dispute occurs between you (as a member of the site) and any other member(s) of the site you agree to release us from any claims, demands or damages of any kind which arise out of the dispute or are connected to one in any way.
BuySellWordpress may try to help its users to resolve the disputes, for the benefit of Buyers or Sellers, but has no obligations to do so.
On BuySellWordpress marketplace we provide non-tangible products. These purchased products which are downloaded are not refundable. There are no cancellations of online orders that have been downloaded successfully.
However, there are cases in which refund can be issued.
Should you request the refund, please contact BuySellWordpress support team and provide the following information:
- - Your email address
- - You order id
- - The item id (name) you’re referring to
- - Formal reason of refund
Once received, the refund request will be reviewed and examined by BuySellWordpress team within 24-48 hours. You will be contacted by a manager from our team once the request is processed.
11. Amendments to the following terms
BuySellWordpress, in its sole discretion, has the right to amend these Terms of Use. Once the amendments are made they become effective immediately after being posted on the site. If you continue to use the site you agree to the amended Terms of Use.
